いつも株式会社Ｒｕｎｐａｔｈ（以下「当社」）のゲーム、またそれに付随するサービス（以下「サービス」）をご利用いただきありがとうございます。
当社ではより多くの方にサービスを親しみ、広めていただけるよう、当社サービスについての二次創作に関するガイドライン（以下「本ガイドライン」）を制定しました。
当社サービスを利用し、二次創作を行う際は、以下の内容をご理解の上でお楽しみください。

本ガイドラインは、当社サービスを正規の方法でご利用いただいているお客様（以下「お客様」）が、当社が権利を有する知的財産を利用する場合に適用されます。制作内容に当社以外の第三者が有する知的財産が含まれる場合は、適切な所有者からの許諾を得る必要があります。当社以外の第三者が有する権利の所在に関するお問い合わせについてはお答えいたしかねます。

本ガイドラインの対象者

本ガイドラインは個人・法人問わず全てのお客様を対象としております。

対象のサービス

本ガイドラインの対象となるサービスは、当社で取り扱うサービス全般に対して適用されます。
また、いくつかのサービスでは、個別にガイドラインを設ける場合があります。それら個別に設けたガイドラインは、このガイドラインより優先的に適用されます。

二次創作の許諾範囲

個人・法人問わず、お客様の非営利目的の利用に限り、下記利用条件の範囲内であれば、二次創作をご自由に行うことができます。
下記利用条件から逸脱する、又は禁止事項に抵触する等、当社が不適切と判断した二次創作に関しては、削除や損害賠償を求める等の措置を講じることがあります。

利用条件

  1. 個人・法人を問わず、非営利目的の場合に限り、二次創作が可能です。
  2. 二次創作内にサービスに関するネタバレが含まれる場合、方法は問いませんが事前にネタバレがあることが分かるようご配慮ください。
  3. ネタバレに関して、基本発売日から解禁となりますが、一部サービスに限り解禁までの期間又は公開可能制限を設けています。制限のあるサービスについては、以下の表をご確認ください。
  4. 二次創作に関して、第三者とトラブルが発生した場合は、お客様の責任にて解決いただき、当社は一切の責任を負いませんので予めご注意ください。
  5. 二次創作に関して、当社広告、イベント等で紹介させていただく場合がございますこと、予めご了承ください。

禁止事項

  1. 利用規約、本ガイドライン、その他規約等当社が定めるルールで禁止とされている行為及び表現。
  2. 当社サービスのイメージや品位を逸脱、損なう行為及び表現。
  3. 当社の公式サービスと詐称し、又は誤認されるおそれのある行為及び表現。
  4. 個人情報若しくは個人を特定できる情報を掲載し、又は掲載を強要する行為及び表現。
  5. 憲法、条約、法律、条令その他の法令等に違反し、又は肯定若しくは助長する行為及び表現。
  6. 個人、団体及び企業等への攻撃や誹謗中傷を目的とする、あるいはそう受け取られるおそれのある行為及び表現。
  7. 特定の思想信条や政治的、宗教的な主張を含む行為及び表現。
  8. 差別的又は差別を助長する行為及び表現。
  9. 過度に性的な描写を含む行為及び表現。
  10. 公序良俗に反する又は反社会的な内容を含む行為及び表現。
  11. 第三者の権利を侵害し、又は侵害するおそれのある行為及び表現。
  12. ゲーム内の要素（画像、音楽、ボイス等）を分割し、個別に投稿、配布する行為。
  13. その他当社が不適切と判断する行為及び表現。
上記に関わらず、当社が理由の如何を問わず、二次創作に対して対応依頼があった場合は、公表された二次創作に対し即時対応をお願いします。
また、別途当社が不適切と判断した二次創作を確認した場合は、削除、配信の停止及び損害賠償を求める等ことがあり、その理由に関しては、お問い合わせいただいてもお答えいたしかねます。予めご了承ください。

収益化

基本的に営利目的での二次創作の利用はお断りしていますが、YouTubeやその他動画共有サイト、XやInstagram等のSNSが提供するクリエイター向け機能を利用し、投稿を収益化することは必ずしも禁止するものではありません。
ただし、有料会員限定の投稿等、視聴者様に対価を必要とするサイトや、サービスを利用することは営利目的とみなし原則禁止といたします。
禁止対象か否かの区別は、当社の判断によるものとし、画一的な基準を設けて公表することはいたしかねます。

免責事項

当社は、サービスに関して、第三者の権利を侵害していないことを含め、いかなる保証もいたしません。
お客様と第三者との間で、二次創作活動をめぐる何らかのトラブルが発生した場合でも、当社は一切の損害賠償責任を負いません。

その他

本ガイドラインは、当社が知的財産を保有するサービスに関連するModの制作や、映像、スクリーンショットを用いた動画や静止画等の二次創作活動に関して定めたものです。ただし、本ガイドラインは当社サービスに関する全ての利用を許諾するものではありません。

本ガイドラインの変更

本ガイドラインは、必要に応じて改正することがあります。必ず最新のガイドラインを確認の上、二次創作をお楽しみください。

Thank you for using the games and associated services ("Services") of Runpath Inc. ("we" or "us").
We have established guidelines on fanfiction from our Services ("Guidelines") so that our Services will be liked and spread by as many people as possible.
Please read and understand these Guidelines before using our Services and creating fanfiction.

These Guidelines apply if you are a legitimate user of our Services and intend to use intellectual property to which we have the rights. If your fanfiction contains any intellectual property owned by a third party other than us, you need to obtain a license from the appropriate owner. We are not in a position to answer inquiries about the rights of a third party.

Applicability of these Guidelines

These Guidelines apply to all of our customers, both individual and corporate.

Covered Services

These Guidelines apply to all of our Services in general.
Individual guidelines may be established for some Services. Those individual guidelines, if any, will take precedence over these Guidelines.

Scope of a fanfiction license

Subject to the terms of use set forth below, you may create fanfiction without restriction solely for non-commercial purposes, regardless of whether you are an individual or corporate customer.
If your fanfiction deviates from the terms of use below or violates any of the prohibitions, or we otherwise consider it to be inappropriate, we may take appropriate actions, such as requiring you to delete it and seeking damage compensation from you.

Terms of use

  1. Regardless of whether you are an individual or corporate customer, you may create fanfiction solely for non-commercial purposes.
  2. If your fanfiction contains any service spoiler, you should give an advance warning in one way or another.
  3. The prohibition of spoilers is basically lifted on the release date, but for some Services, a no spoiler period or publication restrictions are set. Please see the table below for the Services to which these restrictions apply.
  4. Please note that if any trouble occurs between you and a third party in connection with your fanfiction, it must be resolved on your own responsibility and we will not assume any responsibility.
  5. Please note that we may mention your fanfiction in our advertisements, events, etc.

Prohibited matters

  1. Acts and expressions prohibited in the terms of use, these Guidelines, and our other terms and rules
  2. Acts and expressions that deviate from, or damage the image and dignity of, our Services
  3. Acts and expressions that falsely purport to be, or may be mistaken for, our official Services
  4. Acts and expressions that contain personal information or personally identifiable information, or force its inclusion
  5. Acts and expressions that violate, or advocate or encourage the violation of, the constitution, treaties, laws, ordinances, or other legislation
  6. Acts and expressions that are intended to, or may be taken as being intended to, attack or slander an individual, group, company, etc.
  7. Acts and expressions that contain a specific thought or creed, or political or religious contention
  8. Acts and expressions that are discriminatory or encourage discrimination
  9. Acts and expressions that contain excessively sexual depictions
  10. Acts and expressions that go against public order and morals or are antisocial
  11. Acts and expressions that violate or may violate the rights of a third party
  12. Dividing in-game elements (images, music, voice, etc.) and posting and distributing them separately
  13. Any other acts and expressions that we consider to be inappropriate
Notwithstanding the foregoing, if we receive any request to do something about your fanfiction for whatever reason, you must immediately take appropriate actions about your published fanfiction.
Please note that if we otherwise confirm that your fanfiction is inappropriate, we may require you to delete it or suspend its distribution, and seek damage compensation from you. The reasons will not be disclosed to you even if you ask.

Monetization

In principle, you are not allowed to use your fanfiction for commercial purposes, but you are not prohibited from monetizing your postings using creator functions provided by YouTube or other video sharing services, or X, Instagram or other social media services.
However, you are basically prohibited to make postings that are exclusive to paid members, or use websites or services that collect charges from viewers because these are considered to be intended for commercial purposes.
A decision as to whether a particular act is prohibited or not is left to our discretion, and we will not establish and publish any uniform criteria.

Disclaimer

We make no warranties as to the Services, including non-infringement of third-party rights.
If any trouble arises between you and a third party in connection with your fanfiction activities, we will assume no liability for damage.

Other

These Guidelines cover the production of mods related to the Services to which we have intellectual property, and the creation of fanfiction, such as videos and still pictures using videos and screenshots. However, these Guidelines are not intended to grant a license for all uses of our Services.

Revision of these Guidelines

These Guidelines may be revised when needed. Please be sure to read the latest version of these Guidelines, and enjoy fanfiction works accordingly.
